Same Team Schools Educator Agreement
Version 1.0 · Effective October 1, 2026 · Same Team Educational Resources, LLC (“Same Team,” “we,” “us”). This Agreement covers educators and school staff who use Same Team Schools with an individual account.
1. Accepting this Agreement
You accept this Agreement by checking “I have read and agree to the Same Team Schools Educator Agreement” when you create your account or buy a plan. This is an individual teacher subscription. Section 11 limits what Same Team can owe.
2. What Same Team Schools is, and what it is not
- Training materials and working tools for teachers, case managers, and administrators, built on the experience of Elizabeth Long, Ph.D.
- It is not a system of record. It does not replace your district’s IEP system, forms, signatures, state reporting, or Medicaid billing.
- It is not legal advice. It does not replace your district’s policies, your state’s regulations, or guidance from your special education administration or district counsel.
- Everything the tools produce, including goals, present levels, notices, schedules, deadlines, and letters, is a draft for the IEP or 504 team’s professional judgment. The team, not Same Team, is responsible for what goes into a student’s plan and for meeting legal timelines.
- Some tools use automated software, including artificial intelligence. Outputs can be incomplete or wrong. Review everything before you use it.
3. Free trial
- Every plan you start begins with a 7-day free trial of the full toolkit. A payment card is required to start.
- The trial starts when you choose a plan. Your card is charged automatically on day 8 unless you cancel before then. You can cancel any time from Manage billing.
- We may end trials that are used to get around paying.
4. Student privacy: built so we never hold a student’s name
Same Team Schools is designed so that student personally identifiable information does not come to us.
- Staff enter student numbers from a key sheet, not names. The key sheet stays on your own computer, and names are added only at print time on your computer.
- The tool pages are built so they do not send what you type about a student to Same Team.
- Your account holds your own work email and account details, not student records.
You agree to use the tools as designed: do not type student names, dates of birth, or other identifying details into free-text boxes; do not upload student records to Same Team; and follow your district’s policies on student data, including FERPA and your state’s student-privacy laws. If a document you open in a tool contains student information, it is read on your own computer and is not sent to us.
5. Plans, automatic renewal, cancellation, and refunds
PAID PLANS RENEW AUTOMATICALLY AT THE END OF EACH BILLING PERIOD UNTIL CANCELED. THE PRICE, BILLING FREQUENCY, AND RENEWAL TERMS ARE SHOWN BEFORE YOU PAY. YOU CAN CANCEL ONLINE AT ANY TIME.
- Cancellation stops future charges. Access continues to the end of the paid period.
- Refunds: if you are not satisfied, email info@sameteameducationalresources.com within 30 days of a charge and we will refund that charge. Otherwise, fees paid are not refundable except where the law requires.
6. Acceptable use
- Use the toolkit for your professional work with students your role serves.
- Do not share your account, resell or republish our materials, or try to break or get unauthorized access to the service.
- Schools and districts may share the handbooks internally for professional development with attribution, as each guide states. Any other use needs our written permission.
7. Our content
The handbooks, guides, tools, and software belong to Same Team or its licensors. While your account is active, you may use them for your own professional work. Documents you create with the tools are yours and your district’s.
8. Not an emergency service
Same Team Schools is not an emergency or crisis service. Follow your school’s emergency procedures and call 911 when anyone is in danger.
9. Your promise to cover us (indemnity)
If someone makes a claim against Same Team, Dr. Long, or our owners, employees, or contractors because you broke this Agreement, broke the law (including student-privacy law), or entered or shared information you were not allowed to share, you agree to cover the reasonable costs and losses that result, including reasonable attorneys’ fees, to the extent the law allows. This does not cover losses caused by our own fault.
10. Disclaimer of warranties
TO THE FULLEST EXTENT THE LAW ALLOWS, SAME TEAM SCHOOLS IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY OUTPUT MEETS THE REQUIREMENTS OF ANY LAW, REGULATION, OR DISTRICT POLICY.
11. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS: (A) SAME TEAM, DR. LONG, AND OUR OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING DUE-PROCESS, COMPENSATORY-SERVICES, OR ATTORNEYS’-FEE AWARDS AGAINST A SCHOOL OR DISTRICT, OR LOST PROFITS; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO SAME TEAM SCHOOLS OR THIS AGREEMENT IS LIMITED TO THE AMOUNT PAID TO US FOR THE ACCOUNT OR PLAN IN THE TWELVE (12) MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), IF GREATER.
These limits do not apply where the law does not allow them, including to liability for our fraud, willful or wanton misconduct, or gross negligence.
12. Disputes, governing law, changes, and general terms
Sections 14 through 17 of the Same Team Member Agreement (Families) apply to this Agreement in the same way: talk to us first; small claims; Alabama law; Morgan County venue; notice of material changes; ending an account; and general terms.
