Same Team Member Agreement (Families)

Version 1.0 · Effective October 1, 2026 · Same Team Educational Resources, LLC, an Alabama limited liability company (“Same Team,” “we,” “us”).

1. Please read this before you create an account or subscribe

This Agreement is a contract between you and Same Team. You accept it by checking the box that says “I have read and agree to the Same Team Member Agreement” when you create your account or buy a subscription. If you do not agree, please do not create an account or subscribe. Section 12 limits what Same Team can owe you, and Section 14 explains how disagreements are handled. Please read both.

2. What Same Team is, and what it is not

Same Team gives parents and guardians educational information, planning tools, templates, and guidance about special education and Section 504, built on the experience of Elizabeth Long, Ph.D.

  • Same Team is not a law firm, and nothing we provide is legal advice. Using Same Team does not create an attorney–client relationship.
  • Same Team does not provide medical, psychological, therapy, diagnostic, or evaluation services, and nothing we provide replaces a qualified professional.
  • We do not represent you, attend meetings for you, or act as your advocate with a school or district unless we agree to that separately in writing.
  • Every child, school, and state is different. We cannot and do not promise any particular result from a school, evaluation, meeting, complaint, or dispute.

You make your own decisions about your child. For advice about your specific legal situation, please talk with a qualified attorney. Your state’s parent training and information center can also help at no cost.

3. Dr. Long’s Assistant, the tools, and answers that could be wrong

Some parts of Same Team, including Dr. Long’s Assistant, use automated software, including artificial intelligence, to produce answers, summaries, letters, and calculations. These can be incomplete, out of date, or wrong.

  • Treat every answer, letter, date, and calculation as a starting point to check, not a final answer.
  • Deadline and timeline tools estimate dates from federal and state rules and the information you enter. Your district’s calendar and your state’s rules control. Confirm important dates in writing with your school or district.
  • Laws and regulations change. We work to keep our information current but cannot guarantee it is current on the day you read it.

4. Premium reviews and messages

If your plan includes personal review or messages from Dr. Long, those are educational opinions from an experienced educator, given from the documents and information you share. They are not legal advice. Response times are goals, not guarantees. Online members do not receive personal responses, except as described in Section 5.

5. Not an emergency service

SAME TEAM IS NOT AN EMERGENCY OR CRISIS SERVICE. IF A CHILD OR ANYONE ELSE IS IN DANGER, CALL 911. FOR A MENTAL-HEALTH CRISIS, CALL OR TEXT 988.

If you tell us about a safety concern, we will try to point you to help, but we cannot monitor messages around the clock and cannot guarantee how quickly anyone will read them.

6. Who can use Same Team, and your account

  • You must be at least 18 and a parent, legal guardian, or other adult authorized to support the child whose information you use.
  • Keep your password private. You are responsible for activity on your account. Tell us right away at info@sameteameducationalresources.com if you think someone else has used it.
  • Give us accurate information, and keep your email address current so you receive billing and account notices.

7. Your documents and your privacy

You keep ownership of the documents and information you upload. You give us permission to store and use them only to provide the service you asked for, keep it secure, and meet our legal obligations. Our Privacy Policy explains what we collect and how we protect it, and it is part of this Agreement.

  • Upload only information about your own child, or a child you are authorized to support.
  • You can delete documents from your Vault at any time. When you close your account, we delete your documents as described in the Privacy Policy, except where the law requires us to keep something.

8. Subscriptions, automatic renewal, cancellation, and refunds

Before you pay, the checkout page shows the plan, the price, how often you will be charged, and that your subscription renews automatically. By subscribing, you authorize us (through our payment processor) to charge that amount on that schedule until you cancel.

YOUR SUBSCRIPTION RENEWS AUTOMATICALLY AT THE END OF EACH BILLING PERIOD UNTIL YOU CANCEL. YOU CAN CANCEL ONLINE AT ANY TIME FROM “MANAGE BILLING” IN YOUR DASHBOARD.

  • Cancellation stops future charges. You keep access until the end of the period you already paid for.
  • If we change the price of your plan, we will email you before the change takes effect at least 30 days before, and you can cancel before you are charged the new price.
  • Refunds: if you are not satisfied, email info@sameteameducationalresources.com within 30 days of a charge and we will refund that charge. Otherwise, fees already paid are not refundable, except where the law requires a refund.

9. Acceptable use

  • Use Same Team only for lawful, personal purposes connected to a child you are authorized to support.
  • Do not copy, resell, republish, scrape, or share our content, tools, or your account with others.
  • Do not try to break, overload, reverse-engineer, or get unauthorized access to the service.
  • Do not upload anything unlawful, or anything you do not have the right to share.

10. Our content

Same Team’s guides, templates, tools, articles, and software belong to Same Team or its licensors. While your account is active, we give you a personal, non-transferable permission to use them for your own family’s needs. Letters and documents you create with our templates are yours to use in your child’s case.

11. Disclaimer of warranties

TO THE FULLEST EXTENT THE LAW ALLOWS, SAME TEAM IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY ACCURATE, OR THAT IT WILL PRODUCE ANY PARTICULAR RESULT, AND WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS: (A) SAME TEAM, DR. LONG, AND OUR OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, OR EDUCATIONAL OUTCOMES, ARISING FROM OR RELATED TO SAME TEAM, EVEN IF WE WERE TOLD THEY WERE POSSIBLE; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO SAME TEAM OR THIS AGREEMENT, UNDER ANY LEGAL THEORY, IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM.

In plain words: if Same Team gives you a wrong answer, a wrong date, or a letter that does not work, the most you can recover from us is what you paid us, and we would rather simply refund you under Section 8.

These limits do not apply where the law does not allow them, including to liability for our fraud, or for our willful or wanton misconduct or gross negligence. Some states do not allow certain limits, so some of this section may not apply to you.

13. Your promise to cover us (indemnity)

If someone makes a claim against Same Team, Dr. Long, or our owners, employees, or contractors because you broke this Agreement, broke the law, or uploaded or shared something you did not have the right to share, you agree to cover the reasonable costs and losses that result, including reasonable attorneys’ fees. We will tell you about the claim promptly and let you take part in the defense. This section does not require you to cover losses caused by our own fault.

14. If we disagree

  • Talk to us first. Email info@sameteameducationalresources.com and describe the problem. We will try in good faith to resolve it within 30 days, and most problems end with a refund.
  • Either of us may bring an individual claim in small-claims court if it qualifies.
  • This Agreement is governed by the laws of the State of Alabama, without regard to its conflict-of-laws rules. Any court case not in small claims will be brought in the state or federal courts located in Morgan County, Alabama, unless the law of your state requires otherwise.

15. Changes to this Agreement

We may update this Agreement. We will post the new version with a new date. If a change is important, such as fees, cancellation, or this Agreement’s limits, we will email you at least 30 days before it takes effect. Changes do not apply to a dispute that arose before the change. If you do not agree to a change, you can cancel before it takes effect.

16. Ending your account

You can close your account at any time. We may suspend or close an account that breaks this Agreement or puts others at risk, and we will refund any unused prepaid fees unless the account was closed for fraud or abuse. Sections 7, 10, 11, 12, 13, 14, and 17 continue after your account ends.

17. General terms

This Agreement, the Privacy Policy, and the terms shown at checkout are the whole agreement between us about Same Team. If any part is found unenforceable, the rest stays in effect, and that part will be enforced as far as the law allows. You may not transfer this Agreement; we may transfer it to a successor to our business. If we do not enforce a term right away, we have not given it up.
