Discipline & Suspension — When a Child With an IEP or 504 Is Disciplined

Can my child with a 504 Plan be suspended?

Reviewed by Dr. Elizabeth Long, Ph.D. — Director of Special Education, 32 years in public schools.

Yes. A Section 504 Plan does not prevent a school from disciplining a student. However, Section 504 includes protections for students with disabilities when discipline may result in a significant change in placement.

A school may need to conduct a manifestation determination before making such a change. The specific requirements under Section 504 differ from IDEA, so parents should ask the school what process applies to their child's situation.
