IDEA requires a BIP in one specific circumstance: when a student's behavior leading to a disciplinary change of placement is found to be a manifestation of their disability. In that case, the IEP team must implement a new BIP, or review and modify an existing one. Outside of discipline, a BIP isn't automatically mandated by federal regulation, but it's standard best practice — and something an IEP team can and often should adopt whenever a student's behavior is significantly affecting their access to education.
